Mediation can take place before or after legal action is initiated. The agreements reached in mediation may resolve some or all issues between the parties. Typically, the mediation results in a written agreement which outlines the points of agreement between the parties. That mediated agreement can be used to produce Court orders.
Mediation is not a substitute for independent legal representation. Lawyers advise their clients of their legal rights and obligations and tell them what to expect if they go to court. The attorney may act as an advisor and consultant and prepare any documents which must be filed with the court. The mediator does not provide legal advice and does not prepare documents for court filing.
